AUCTION TERMS
Saturday, December 1, 2018 – Springfield, Ohio

REAL ESTATE:
Down Payment: 10% of sales price as down payment due on the day of the auction. The down payment may be paid in the form of cash, personal check, business check, or cashier’s check. Checks will be made payable to Harvey Plus. The remainder of the purchase price is payable at the closing of the transaction.

Acceptance of Bid Prices: Successful bidder is required to sign a Purchaser’s Agreement at the Auction site immediately following the close of the Auction. The Buyer’s obligation to close the sales transaction will not be contingent upon an inspection or Buyer’s ability to obtain financing. The earnest money will be nonrefundable. Sale of the property is conditional upon the seller accepting the final, high bid. Seller retains the right to reject the final bid.

Closing: Buyer will have 45 days to close on the property.

Possession: At closing.

Title: Property is selling with good marketable title.

Real Estate Taxes and Closing Costs: The Buyer shall pay all costs associated with the Closing of the transaction evidenced hereby. Ad valorem property taxes for the then-current tax will be pro-rated between the Seller and Buyer as the date of the Closing. All property taxes applicable to the property for prior tax years remaining unpaid at the time of the Closing shall be paid in full by Seller prior to or at the time of the Closing. Any tax arising from a change in use of the property, which results in rollback tax shall be borne by Buyer. Title insurance, if desired, shall be paid by the buyer.

Easement: Sale of the property is subject to any and all easements or restrictions of record.

Agency: Harvey Auction Co. LLC., Harvey Plus LLC. and its representatives are Exclusive Agents of the seller.
